OŚWIADCZENIE PRAWNE GRUPY DELUXE

Grupa Deluxe, jako jedyny i wyłączny właściciel całości praw własności intelektualnej, przemysłowej i komercyjnej związanych z marką Deluxe Crystal Vodka, niniejszym oświadcza, że wszelkie stosunki prawne i gospodarcze z podmiotem Deluxe Distribution LLC zostały definitywnie i nieodwołalnie zakończone w trybie natychmiastowym, w związku z rażącym naruszeniem fundamentalnych postanowień kontraktowych, jak również trwałą utratą zdolności zaufania w profesjonalnym obrocie gospodarczym.

Deluxe Distribution LLC utraciło wszelkie prawa do posługiwania się znakiem towarowym, wizerunkiem, etykietą, logotypem, opakowaniem oraz jakimikolwiek materiałami lub oznaczeniami stanowiącymi elementy chronione prawem marki Deluxe Crystal Vodka.

Grupa Deluxe informuje, że:

jakakolwiek działalność tego podmiotu w zakresie promocji, handlu, eksportu lub dystrybucji produktów oznaczonych marką Deluxe Crystal Vodka nie posiada charakteru autoryzowanego i stanowi bezprawną ingerencję w dobra niematerialne podlegające ochronie na mocy obowiązujących przepisów prawa krajowego i międzynarodowego, w szczególności prawa własności przemysłowej, ustawy o zwalczaniu nieuczciwej konkurencji oraz przepisów karnych;

każdy przypadek posługiwania się nazwą Deluxe Crystal Vodka poza systemem autoryzowanej dystrybucji narusza integralność jakościową i rynkową naszej marki, a zarazem wprowadza odbiorców w błąd co do źródła i legalności produktu.

Wobec zaistniałych okoliczności Grupa Deluxe prowadzi aktualnie postępowania cywilne i przygotowuje działania prawne w trybie międzynarodowym, mające na celu:

bezwzględne przeciwdziałanie dalszym naruszeniom,

ochronę interesów prawnych i komercyjnych Grupy Deluxe,

oraz zachowanie najwyższych standardów jakości, bezpieczeństwa i transparentności łańcucha dostaw dla wszystkich legalnych produktów oznaczonych marką Deluxe Crystal Vodka.

Podjęto już wielotorowe i skoordynowane działania prawne o charakterze prewencyjnym, egzekucyjnym i informacyjnym we właściwych jurysdykcjach, celem odcięcia obrotu nieautoryzowanego, ochrony interesów wierzytelnych kontrahentów oraz wyegzekwowania pełni praw przysługujących Grupie Deluxe jako wyłącznemu dysponentowi marki.

DELUXE GROUP LEGAL STATEMENT

Regarding unlawful activity by Deluxe Distribution LLC

Deluxe Group, as the sole and exclusive owner of all intellectual, industrial, and commercial property rights associated with the Deluxe Crystal Vodka brand, hereby declares that any and all legal and business relations with the entity Deluxe Distribution LLC have been definitively and irrevocably terminated with immediate effect, due to flagrant violations of fundamental contractual provisions and a permanent loss of trust in professional business dealings.

Deluxe Distribution LLC has lost all rights to use the trademark, image, label, logo, packaging, or any materials or identifiers that are legally protected under the Deluxe Crystal Vodka brand.

Deluxe Group announces that:

any promotional, commercial, export or distribution activity undertaken by this entity under the Deluxe Crystal Vodka brand is unauthorized and constitutes an illegal infringement of intangible assets protected by national and international laws, including intellectual property rights, unfair competition laws, and criminal provisions;

any use of the name Deluxe Crystal Vodka outside the authorized distribution system compromises the quality and market integrity of our brand and misleads recipients regarding the source and legality of the product.

Given these circumstances, Deluxe Group is currently conducting civil proceedings and preparing international legal action aimed at:

strictly preventing further violations,

protecting the legal and commercial interests of Deluxe Group,

and ensuring the highest standards of quality, safety, and transparency in the supply chain of all legally distributed Deluxe Crystal Vodka products.

Multi-pronged and coordinated legal measures—preventive, enforcement, and informational—have already been initiated in the appropriate jurisdictions to cut off unauthorized trade, protect the interests of legitimate partners, and enforce all rights belonging to Deluxe Group as the exclusive brand owner.
